Is crypto regulated in Germany?
Yes. Germany applies MiCA, the EU’s crypto law, and BaFin supervises it. Only companies licensed in Germany or in another EU country may serve customers here, and all six on this page are. Binance has no MiCA licence anywhere in the EU. You can look any company up in BaFin’s or ESMA’s register.
A licence means the exchange must keep your crypto separate from its own and follow EU rules, but crypto is not covered by deposit insurance.
Taxes
Today, crypto you sell after holding it for more than a year is tax-free. Sell sooner and the gain is taxed at your personal income tax rate, unless all your private sale gains for the year stay under €1,000. Staking does not extend the one-year period. A draft from the finance ministry, not yet approved by the cabinet in October 2026, would tax crypto bought from 1 January 2027 at a flat 25% plus solidarity surcharge, however long you hold it; crypto bought before then would keep today’s rules. Since January 2026 exchanges across the EU report their users’ crypto to the tax office under DAC8. Keep a record of every buy and sell and ask a tax adviser before filing.
